Thank you for visiting inspirepaintings.com. We are an online retail store and website which creates paintings from reference submitted by our customers. Use of the InspirePaintings.com website or any of its services expressly acknowledges acceptance of the following Terms and Conditions. To protect your own interests please read our Terms and Conditions carefully before ordering which indicates accepting them. If you are uncertain as to your rights or want any explanation about our Terms and Conditions please email inspirepaintings1@gmail.com. These Terms and Conditions contain the whole of our agreement relating to your purchase. They cannot be altered or changed unless an approval to do so is signed by a representative of Inspire Paintings.

We reserve the right, at our own discretion, to edit, supplement or in any way modify these Terms and Conditions or any policy referenced herein. Such changes will be effective upon posting to the Site, and your continued use of the site thereafter indicates your acceptance and acknowledgement of the terms.

Resale, Rights, Duplication

All goods supplied by Inspire Paintings are for personal use and not permitted for re-sale without an agreement. We reserve the right to refuse to supply any person or company. If you are interested in re-selling our products in larger scale, please contact us.

When a reference photo is submitted, you agree to let Inspire Paintings artistically interpret that photo into a digital and then physical painting. You retain the rights of that original photo and Inspire Paintings holds the rights to the painting as a digital file as well as the physical file. You are not permitted to copy, scan, reproduce or in any other way reproduce the digital or physical paintings without consent of Inspire Paintings.

When purchasing a painting, you will sign a release form giving the artist rights to use the likeness for the painting. You will also be given the option to give permission for the artist to use the painting as part of a gallery/portfolio or for marketing purposes. Inspire Paintings will never sell your painting to a third party without your consent.



Delivery/Damage Policy

All our products are physical products shipped via different mail services depending on your location and product details. Shipping can take up to 14 business days; however, usually only 3-7 business days are required.

We will not be held responsible or offer any form of refund for delays in the delivery of the products as this is due to a third party and is out of our control.

We estimate that the total turnaround time from start to finish is on average 7 business days, depending on when you need it. We will use all reasonable endeavors to adhere to the delivery times set out, but please note these are not guaranteed. If you would like to receive your painting quicker than the stated delivery timeframe, there is an option to have a rush fee applied, which will expedite the delivery.

Art Direction

Please note that by ordering a painting from InspirePaintings.com, you are giving the artist full license to create it however is deemed fit based on some initial questions which will be asked. Unless specifically agreed, this is not considered a commissioned/directed work, as that would add much more time and cost to the process. You will be able to offer some feedback when reviewing the thumbnail, but in order to be as efficient as possible, any changes will need to be minimal.

Payment Methods

Cancellation of Order & Refund Policy:

It is not permitted for the customer to submit new photos after the painting process has begun. Once you have received your initial preview photo and this has been approved it is not possible to cancel your order at this stage. No refunds will be offered, even if the agreed preview this is due to camera, screen resolution and light effects. Our products are all custom hand made as per the customer's designations and so refunds are not possible once the process has started. The sale is final.

Certain card issuing banks may charge you an "International Service Fee" depending on your location, regardless of whether or not a currency conversion is involved. This additional charge is not made by Inspire Paintings or its payment processors, but is made entirely at the discretion of your card issuing bank. We can therefore not refund such charges as they are not from us. Please, contact your bank in such cases and consider filing a complaint. Our liability is limited to the amount you paid.

We are committed to protecting your privacy and providing you with the means to make secure purchases. 

We will not sell or pass the information we collect on to any third parties. We will use the contact information provided by you via the website www.inspirepaintings.com or via email to communicate with you by email or phone. You also agree to received information and updates about your order, and, about special promotions we run. In this section we refer to "personally identifiable information", which is information that enables us to identify you, such as your email address, phone number, name, and postal address. Like many e-commerce web sites InspirePaintings.com works with Stripe which is 100% secure online payment service provider. Our chosen partners are securely managing all customer data in accordance with consumer data protection legislation. The website uses following cookies: We are using Google Analytics. This cookie allows us to see information on user website activities, including, but not limited to page views, source and time spend on website. The information is depersonalized and is displayed as numbers, meaning it cannot be tracked back to individuals. This will help to protect your privacy. Using Google Analytics we can see what content is popular, and strive to give you more of the things you enjoy reading and watching. By using Google Ads / Bing Ads /Yahoo Ads tracking codes we are able to see which of our ads convert into orders. This allows us to make better use of our paid search budget. We use remarketing codes to log when users view specific pages, allowing us to provide targeted advertising in the future. Customers ordering on this website agreeing on receiving in future our newsletters and promotional emails. By using InspirePaintings.com and placing an order, you agree to have your completed products displayed on our website and Facebook page, unless we receive written instructions not to use the images and finalized products.

General Terms 

Inspire Paintings will make every effort to ensure that the website and other services are available continuously but reserves the right to modify, suspend, or discontinue all or any part at any time with or without notice. In no circumstances will Inspire Paintings, www.inspirepaintings.com, the owner of this domain (www.inspirepaintings.com) be liable for any loss or damages, whether direct, or consequential arising out of: (a) your use of Inspire Paintings site, services, or your inability to do so; (b) your reliance on any content and/or: (c) goods and services in any way associated with the site and services. (d) Taxes and duties which maybe be due in your state or country. We will not be liable to you for any loss or damage caused by us, our managers, our employees, our agents, the owner of this domain, in circumstances where: (a) there is no breach of duty of care owed to you by us or by any of our manager, our employees or agents; (b) such loss or damage is not a reasonably foreseeable result of any such breach; (c) any increase in loss or damage results from breach by you of any of these Terms and Conditions; (d) such loss or damage relates to any business or non-consumer loss or damage including, without limitation lost data, lost profits, and business interruptions.

We do not accept any responsibility for items held or delayed by customs. We deliver to dozens of countries around the world, and we are unable to keep track with any local import regulation. Customers in the United States are required to pay any sales or use tax required by the laws of their US States. All paintings are made to order and are custom made. We will send you a proof of the completed painting for your approval.  We reserve the right to alter prices for new orders without prior notice. Prices for orders in progress will not be altered. 

Copyright

All images on our site are either licensed or in the public domain because their copyright has expired. This applies to the United States, Canada, the European Union and those countries with a copyright term of life of the author plus 50 -70 years. However, mistakes do happen. If you find any content on this website that you believe to be under copyright protection, please contact us immediately and it will be removed. In addition, faithful reproductions of two-dimensional original works cannot attract copyright in the U.S. according to the rule in Bridgeman Art Library vs. Corel Corp. 

For all portrait paintings as well as paintings on request customers are both responsible and liable for the images they upload on our website or send via email. Customers are required to verify that they hold the copyrights of the images provided to us, and we assume permission to use those images for the creation of the paintings. We will not be liable for any paintings InspirePaintings.com paints derivative works on customers' behalf based on photographs provided by the customer. By ordering, customers permit us to use the images they upload and images of the final product on our websites and Facebook pages, however, customers can cancel this permission anytime in writing, and we will take down such images within a reasonable period of time. 
 
Our paintings are not photographic reproductions and might differ from the original in size, signature, brushstrokes and other details. Responsibility to ensure that the image is in the public domain, use is within fair use provisions or that any copyright permissions required have been granted remains with the customer.
